Former University of Florida pitcher Jacob Gomberg has been sued in federal court in Florida for allegedly using a so-called "burner account" to distribute non-consensual sexual images of fellow Florida student Madison Kowalski.
The complaint, filed in the Gainesville Division of the U.S. District Court for the Northern District of Florida, is one of three cases filed by Kowalski against men she claims distributed videos of her taken in October 2025 during a sexual encounter that occurred while she was too intoxicated to legally consent.
Gomberg, 21, is from Coral Springs, Florida, and transferred to the University of Nevada-Las Vegas for the 2026 season. He has again transferred, this time to Indiana University in Bloomington, Indiana, for the coming season.
In her complaint, Kowalski alleges that while she was at one or more parties at a fraternity house in Gainesville, she was given alcohol despite being underage. She became too intoxicated to give consent to sexual activity, but nonetheless, "she was subjected to sexual contact and sexual acts to which she did not consent and to which she could not legally have consented."
In the course of the encounter or encounters, "one or more video recordings were created, without Plaintiff’s knowledge or consent, depicting Plaintiff completely nude, depicting her uncovered intimate parts, and depicting her being sexually violated while incapacitated," the complaint says.
In November of 2025, Kowalski alleges that Gomberg, using pseudonymous "burner" accounts, posted the videos to social media and other websites, along with information identifying Kowalski as the woman in the videos.
When she found out that the videos of her were circulating, she "sat paralyzed on her couch as anonymous people on the internet endlessly harassed her; they posted her old photos, her dad’s LinkedIn, and even his golf handicap," according to a longform story published this week by WIRED. "They called and texted her parents all through the night, saying things like, 'I gave your daughter drugs and fucked her'; one anonymous man told Kowalski’s father he’d had sex with her and had since tested positive for HIV while playing the call live on Spaces, X’s live chat feature. Another posted on X placing bets on whether, by the end of the coming week, she’d start an OnlyFans or kill herself."
The complaint states that Kowalski "suffered and continues to suffer severe emotional distress, humiliation, shame, anxiety, loss of dignity, damage to reputation, disruption of her education and daily activities[.]"
Kowalski's claims against Gomberg include a federal cause of action for disclosure of intimate physical depictions, a state law cause of action for sexual cyber harassment, and common law claims of intrusion upon seclusion, public disclosure of private facts, intentional infliction of emotional distress.
In addition to Gomberg, Kowalski filed suit on the same day against Brendan Pitfield of Atlanta, Georgia, and Kamran Ahmed of Tampa, Florida.
Gomberg, a 5-foot-10, 180-pound lefty, appeared in four games for Florida in the 2024 and 2025 seasons before transferring, throwing two innings.
